Terms of Use
The short version. WhenFree is a tool that helps you write your own availability into your own messages. You are responsible for what you send and for keeping your calendar accurate. WhenFree Pro is sold as an annual subscription, a monthly subscription, or a one-time Lifetime purchase, all handled by Apple. We provide the app as-is and keep our liability to what the law allows.
1. Agreement
By installing or using WhenFree (the "App"), including its iMessage app, keyboard and widget, you agree to these terms and to Apple's Licensed Application End User License Agreement, which applies where these terms are silent. If you do not agree, do not use the App.
2. Licence
dotdotdotapps grants you a personal, non-transferable, non-exclusive licence to use the App on Apple devices you own or control, as permitted by the App Store usage rules. You may not copy, modify, reverse-engineer, resell or redistribute the App except where the law expressly allows.
3. What the App does and does not do
The App reads calendars on your device and composes text with times you choose. It does not guarantee that a time is genuinely free: calendars sync with delay, other people may add events, and rules you set may exclude or include time you did not intend. Always read the preview before sending. The App does not send invitations, does not book on another person's behalf, and does not read your conversations.
4. Your content
Everything you send with the App is your own message, sent by you through Messages or another app. You are responsible for it. The App keeps no copy and has no access to it after it is sent.
5. WhenFree Pro
WhenFree Pro unlocks the features listed on the purchase screen, in the current version and in future versions of the App, on any device signed in with the same Apple Account, and with Family Sharing if enabled. It is offered in three forms, all sold by Apple through the App Store and all unlocking the same features:
Annual and monthly subscriptions. The Annual and Monthly plans are auto-renewable subscriptions. Payment is charged to your Apple Account at confirmation of purchase. A subscription renews automatically for the same length and price unless you cancel at least 24 hours before the end of the current period; your account is charged for renewal within 24 hours before the end of the period. Manage or cancel any time in Settings › [your name] › Subscriptions on your device. If Apple permits a price change for existing subscribers, we will give notice as required and you may cancel before it takes effect.
Lifetime. "WhenFree Lifetime" is a one-time, non-consumable in-app purchase. It is not a subscription and never renews.
Prices are shown in the App Store before purchase and may change for future buyers. Refunds are handled by Apple under Apple's policies; use reportaproblem.apple.com. If a feature listed as included is removed from the App, we will provide an equivalent or say so in the release notes.
6. Free features
The free version includes the iMessage app, the keyboard, one calendar, working-hours rules and unlimited replies. We may change what is free in future versions, but nothing you have already paid for will be taken away.
7. Privacy
Our Privacy Policy is part of these terms. In short: nothing leaves your device.
8. Availability and changes
We may update, change or discontinue the App or any feature at any time. Because the App has no server, an installed version keeps working as it is even if updates stop.
9. Disclaimer
The App is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that availability shown by the App is accurate or that the App will be error-free.
10. Limitation of liability
To the fullest extent permitted by law, dotdotdotapps is not liable for any indirect, incidental, special or consequential damages, or for lost business, lost appointments, missed meetings or double-bookings, arising from your use of the App. Our total liability for any claim is limited to the amount you paid for the App in the twelve months before the claim. Some jurisdictions do not allow these limits; where they do not, they apply to the extent allowed.
11. Apple
Apple is not a party to these terms and has no obligation to provide maintenance or support for the App. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. Any product-liability, legal-compliance or intellectual-property claim relating to the App is our responsibility, not Apple's, to the extent the law and the App Store terms provide.
12. Termination
These terms end when you delete the App. We may terminate the licence if you breach these terms.
13. Governing law
These terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law rules, except where your local consumer law gives you rights that cannot be waived.
